Report of the Incident That Occurred On Tuesday, June 19th,2007
Inside
The Rayburn Office Building On Capitol Hill, Washington DC.
The
Hon. US Congresswoman, Maxine Waters of California’s 35th District
instigated
the arrest of community activist, Ted
Hayes, me, of all people!
This
particular political dignitary, attempted to take down, humiliate and
scar me with a misdemeanor criminal record, thereby minimizing and
marginalizing my potential influence among American Black US citizens
to stand up against illegal immigration which she supports.
Well,
to say the least...it back-fired in the legendary "Get in yo
face" African American leader's own face. I guess
Ms. Waters didn't really know any better than to tangle with
the forces behind me.
Let
this be a lesson to all the other so-called African American leaders
in the US Congressional Black Caucus or otherwise, who dare to
continue their participation in the demise of my people and this
nation..
Please
pardon me non-Blacks as I chide with my so-called African American
leaders about their irresponsible behavior in the defense of the only
nation that know. But pleas read on........
Now...those
of you who consider yourselves to be representatives of the
descendants of Black West African Americanized United States chattel
slaves and their children, my fore parents and parents, you need
to know and do the following:
*
As of this moment you are being held in contempt of Congressional and
Divine Justice if you don't immediately return to Dream of America and
obey your sacred Oath of Office to defend the Constitution of the
United States and her citizens, from "all foes, foreign and/or
domestic", according to the edicts of the Fourteenth Amendment;
*
You must immediately cease your part in the treacherous
"give-away" of our beloved Civil Rights Legacies and
Heritages to citizens of foreign nations (foreign nationals =
patriotism to their natural countries) who are illegally within and
colonizing the United States;
*
You must immediately begin to listen to the strong suffering heart
beats of our enslaved ancestors, and taste the bitter-sweet tears of
their freed children and feel the wondering and searching spirits
of your constituent US citizen peoples;
*
Upon returning to your post, you will be find grace of the Divine and
a willing people ready to arise from the nightmare of the long and
epic struggle of our ancestors to be free in America and wherever we
may go; and to enter the awaited "Promissory Land" prepared
for us in the United States Constitution...defined by the late Dr.
Martin Luther King, Jr. as the Promissory Note.
Congresswoman
Waters and the members of the Congressional Black Caucus, it is not
too late for you to stop the devastating "runaway train" of
illegal immigration invasion destroying our peoples.
In
fact, we can reconcile, atone and set things right for the sake of our
peoples and every citizen of the United States (* of all colors,
races, ethnicities, religions) or we can contend to an end that
you will not win.
Your
Congressional voting record against American Black citizens, a
betrayal of this great nation that GOD Gave us, can be deleted,
provided that you now begin to obey your sacred Oath of Office that
you took in HIS Presence.
As
you can see, I was acquitted of the charges that the Honorable
Congressional Member had me arrested and tried for at great expense to
myself and other American citizens.
What
was my crime?!? Asking my leader as I ask you, "Why are
selling our country out and giving our Civil Rights Legacies to people
who don't belong here?"
You
too can be acquitted of the charges treason that you are now
confronted with by "We The People" by simply taking my
"hand" in peaceful fellowship for the prosperity of the
American peoples.
Remember,
"If the charge don't fit, you must acquit"

What
Happened On Capitol Hill
Between
Congresswoman Maxine Waters and Ted Hayes
ACQUITTED!
"If
the charge don't, you must acquit"
On
the claims and testimony of the Hon. United States Congress Member, I
was subsequently arrested; hand-cuffed and incarcerated for several
hours; put on trial for a criminal misdemeanor charge; and prosecuted
by District of Columbia;
...and
yet, in light of the prosecution's lack of evidence, the Judge
summarily acquitted of the bogus charges by Maxine Waters thanks to
The LORD and my defense attorney, Mr. Richard C. Baker of Baker
Simmons Attorneys At Law, Washington, DC.
The
unnecessarily aggressive, over verbal African American leader and
Congressional legislator was proven to have a erroneous testimony
against me.
This
Is What Really Happened
On
the afternoon of Tuesday, June 19 th,2007, James Spencer, Terrance
Lang and I were on Capital Hill in the Rayburn Building to lobby the
US Congressional Black Caucus.
We
went there to query them about the disastrous effects of illegal
immigration on American Black US citizens; the loss of Civil Rights;
and continued demise of our people in this country.
This
is when we had an unexpected
confrontation with the Honorable Congresswoman from California's 35th
District, South Los Angeles, the
bodacious Ms. Maxine Waters.
Arrested
As A Criminal Suspect
The
confrontation resulted in my being arrested and charged with
“disorderly conduct in a public building. Originally or
initially with that charge, I was accused by Capital Hill Police with
making a verbal "terrorist threat" to the Congresswoman.
For
obvious reasons, this charge of “terrorist threats” was
immediately dropped.
However,
due to the Honorable Congresswoman's accusations against me, I spent
the vast part of eight (8) hours hand-cuffed in the custody of law
enforcement.
Now
Who's The Criminal
As
you know, in my recent trial in District of Columbia Superior Court,
Criminal Division concerning this matter, I was acquitted and
thereby vindicated of the criminal “disorderly conduct” charge
which makes my word good and that of Ms. Waters untrustworthy and
disingenuous.
In
fact, if anyone should be charged with “disorderly conduct”, as
well as making as inciting the arrest of an upstanding citizen, it is
now Maxine Waters, herself.
The
Genesis of the Incident
James
Spencer, Terrance and I had come to
Washington, DC on Tuesday, June 19th to hold a news conference
decrying the Senate amnesty bill citing the devastation that
illegal immigration has on Black US citizens.
Therefore
we were in DC calling on the US Senate along with most American
citizens, to not pass the bill in question.
After
the news conference, as our custom whenever any of us are in
Washington DC, especially myself, we make it a point to go up on
Capitol Hill to lobby the US Congressional Black Caucus about our dire
concerns around the issue of illegal immigration as it relates to
Blacks in America and our Civil Rights.
While
in an elevator of the Reyburn Office Building, we happened to meet a
small group of about four-five other Black individuals who were
residents of Chicago Illinois on their way to visit with the Honorable
Congresswoman, Maxine Waters from California.
The
Fateful Detour
Originally
we were on our way to make a “cold” call or visit with the
Honorable Congresswoman from Detroit, Michigan, Ms. Carolyn Cheeks
Kilpatrick, who was/is the Chair Person of the Black Caucus.
During
our fun-loving and jovial communications with the Chicago residents
and learning that they were on their way to see/visit our own
California Congressional Representatives, we spontaneously decided to
alter our course and perhaps get a chance as well to visit the
legendary Black leader and legislator, before going on to Ms.
Kilpatrick's office.
Upon
our arrival to the outer guest lobby of her office, Ms. Waters
immediately received the Chicago visitors into her private
office with glee and warm welcome.
In
fact, it was so gleeful in her private office, we could hear them all
from the outer lobby office, including the Congresswoman herself
laughing and joking while taking pictures with them.
We
were sure that our leader would do for us what she did for the
Chicagoans, give to us audience as well, especially being from Los
Angeles.
Mr.
Spencer himself is an actual residential constituent in her 35th
District of Inglewood.
We
learned that the Congresswoman had been alerted by staff of our
presence and waiting to speak with her about our illegal immigration
and Civil Rights concerns.
The
"Great Escape" Foiled
Aware
of our presence, and not wanting to face constituents full of
questions, Ms. Waters tarried hoping that we would become frustrated
and simply leave.
After
some embarrassing time lapsed, and we were not going to vacate, the
Congressional legislator decided to leave, passing through the outer
lobby office into the hall to attend some meeting elsewhere.
Instead
of greeting us in the stately manner required of an elected official
and perhaps, say "Nice to see you, but unfortunately I must have
an appointment, and perhaps we can speak at some other time".
Without a word, the Congresswoman rushed pass us.
The
Echoing Voices In the Halls of Power
At
this point, I followed the Congress Member into the hallway with a
line of questioning in a regular, tone of voice, not shouting.
In
midst of the din swirling around the both of us, I was firmly asking
her, “…why are you selling out our
country, and giving our peoples Civil Rights Legacies to folks who are
here in the United States illegally.” Of
course, I am speaking of folks who are illegal immigrants or citizens
of foreign nations without authoritative documentation in our country.
In
the presence of James Spencer and Terrance Lang, visibly angry with
the “in your face” attitude persona that she is famous for loudly
began her own line of questioning of,
“…why did ya’ll march on my office out in LA? Why did
ya’ll march on my office in out in LA?” As though citizens
are not aloud to redress government for grievances.
In
response to my line of questioning about
“selling out of country”, the
legendary African American leader shouted,
“No! But you full of shit
Ted Hayes. You the sell-out!”
Due
to the Congresswoman’s shouts in an attempt to over-speak and
embarrass me in the hearing of on-lookers, I then raised my voice a
bit louder to equal, if not best hers.
I
repeated to Ms. Waters, “Why are you
selling our country out and giving our Civil Rights Legacies away to
citizen of foreign nations illegally within our?”
At
this point, Ms. Waters began using foul explicative about my person
loudly repeated, “Ted Hayes, you full
of shit. Ted Hayes, you
full of shit”, And I responded, “No
man! We full of YOU!” In other words…
“And
we are going take a ‘laxative’ and ‘colon enema’ to
‘flush’ YOU out of our systems?
Not
taking such treatment from an elected servant, I indeed followed the
Congresswoman loudly questioning her as she continued repeating her
foul cussing.
*
I did not reciprocate her Honor by using foul language in return.
You
Don't Close The Door In The Face of the People
The
Congressional legislator then entered into the front outer public
lobby of her office to close the door in my/our face.
Immediately,
I grabbed the hallway door knob to disallow Ms. Waters from closing
the door in the face of “We The People”.
Not
tolerating any tax paid Representative to shut doors in our faces, on
behalf of the People that she abandoned, I grabbed the outer door knob
of preventing the very angry woman from closing it.
The
outer office lobby areas of the Houses of Congress are opened to the
citizens between the hours of 9:00 AM until 5:00 PM. No
elected official has the right to deny any US citizen access to.
These lobby areas are our, the non-money baring citizens the only real
physical points of direct communications with Congressional
Representatives.
Back
and forth the two of us pulled at the door. (* As a man, I
am physically stronger than Ms. Waters and could have easily torn the
door from her grasp, but that was never my intent.)
By
simply resisting her efforts to close the door, I was able to
demonstrate the point, “you are not allowed
to close the "door" of opportunity and bounty to American
citizens."
All
during this “door knob” scenario, Ms. Waters continued to loudly
hurl foul language at me. “Ted
Hayes, you let go this ‘blank-a-d-blank’ door”.
The
"Queen" Gets Rough
The
Congresswoman’s chief deputy tried to calm her down, release her
grip on the door knob and leave security to deal with me.
*
Clearly, I was no threat to the Congresswoman as she alleged, because
her
chief of staff was standing right by
watching the action between us without
once intervening or interfering to
stop me.
*
He did not even try to grab the door knob himself to assist her….of
which
I recall being bit surprised at his
non-chivalrous action of watching this
“damsel in distress” struggling with
me about that door knob.
*
He never once addressed me about my
behavior, but rather instead rightly
chided and even begged the legislator to
please calm down.
> In other words, “Congresswoman,
let the door-knob go. Mr. Hayes
is not going to hurt you.
Let the staff and I handle this. We will call
security.”
> The young man never once said to me, “Ted Hayes, please calm
down.” Or “Please, let go of
the door-knob, man”, or “Go away, sir.”
My
words to Ms. Waters were “Why are you being
like this? Come on Congresswoman, let’s talk. Why are
you doing this? I won’t let you lock us (that is, the People)
out!
However,
the more the deputy attempted to persuade Ms. Waters to “Please
calm down”, the louder and more belligerent she became, until
finally out of frustration the
Congressional legislator stepped forward and shoved/pushed me in the
chest. (to bad the this was not
caught on camera. Perhaps it was! Maybe someone would like to
investigate – the date is Tuesday, June 19th, directly at and in
front of her office in the Reyburn building around 2 or 3 o’clock
in the afternoon)
The
shove was not hard enough to cause serious physical harm…yet it was
seriousness enough to be a violation of her role as an elected
official, simply because she disagrees with a constituent in the heat
of debate . She is to keep her hands to herself and off of
constituents.
The
Congresswoman pulled a “Cythia McKinny”. As you may recall, the
Honorable Congress Member from Georgia physically attacked a Capitol
Hill Police officer with her cell phone. As a result, her
constituents chose not to send her back to DC. Alas, could this
be the long awaited fate of Ms. Maxine Waters.
I
also noticed that several of the office staff were within hearing of
the commotion and swearing by Ms. Waters. While I can’t attest
to those staffers awareness of the shoving incident, I know
that the chief of staff did witness the Congress Member
physically assault and batter me.
You
Are Supposed To Be Smarter Than This
A
state of disbelief as to what had just
occurred in my chest from the Ms. Waters, I then said to her in
disgust, “Now Congresswoman, what did you
have to go and do that for. That was not smart!”
At
this point I realized that before I get “railroaded”, and that she
would claim that I attacked her or something, I
immediately went on record as being the victim. So I began to
loudly call for security. “Security.
Security. Security”, I shouted.
Security
Arrest Me Instead
Within
a few minutes, whether in response to my shouts for assistance or the
deputies pushed the “hot button” for security or a combination of
both, a Capitol Hill police officer approached, who happened to be
American Black gentleman.
Without
asking what was going on, the officer immediately assumed that I was
in violation and began to escort Ms. Waters to down the hallway to the
elevator banks.
The
officer assumed the rightness of the Congresswoman, and never
witnessed anything about my behavior that would warrant him to
apprehend and arrest me and her who resorted to verbal physical abuse
of a citizen.
Never,
did the officer tell me to be shut up or go away…but he simply asked
me respectfully to keep my physical distance from the Congresswoman.
Of which I immediately complied.
Nevertheless,
I continued to follow them loudly asking the questions to Ms. Waters
because of the significant distance that was established between us by
the officer.
The
Bogus Terrorist Threat
As
we approached the elevators, I called out to the Congresswoman “Your
days are numbered. You are through”
(*
of course, I not thinking her bio-physical demise, but rather that she
was “through” in Congress, because once Black folks discover her
treasonous behavior, they would not vote for her any longer; and/or
the illegal immigrants whose causes she champions would themselves
eventually vote her out of office).
It
was not and is never in my intentions to physically harm the Honorable
Congresswoman.
The
Policewoman and I
About
this time, a female White (Caucasian) officer approached being clearly
excited. Her face was flushed, presumably from running to the
“crime scene”, and appearing somewhat angry, perhaps her demeanor
was due to the din of the situation.
The
officer then shouted at me to show her some identification.
Recognizing her state of excitement, I calmly, but sternly replied to
her as a boss to an employee, “You don’t
shout orders at me to do anything. However, if you ask me
properly, I will comply.”
After
calming herself, she complied with my requests to treat me with
respect and I in turn complied with her demands and showed the Officer
McBride my ID.
At
this point, the female officer led me into the lobby stairway where
there were no witnesses, I was told to wait there and that she
would return.
I
asked the Officer if I were in any serious trouble and what was I
being charged with. She replied, that she didn’t know for
sure, but perhaps that among others, I may be charged with
“terrorist threats” on the Congresswoman.
Even
so, the officer and I seemed to carry on a very cordial conversation,
in fact, she said that they just might let me go.
Got
Me!
About
three minutes later the officer returned and said that I was being
placed under arrest, which she immediately handcuffed and took me back
into the elevator banks lobby area in the sight of many witnesses,
including James Spencer and Terrance Lang.
While
standing handcuffed and waiting news of my fate from the Capitol Hill
police, Congresswoman Waters walked pass me at least twice, of course
noticing my circumstance of being in custody to the police.
Shortly
thereafter, I was escorted by the Capitol Hill police to a waiting
cruiser in sight of several dozens of onlookers in front of the
Reyburn Building, and subsequently taken to the headquarters station
where I was booked and incarcerated for the next 8 hours or so.
You know the rest of the Story.
This
report is true to best of my recollection.
